DUI Charges Dismissed for Client After Judge Grants Motion to Suppress Evidence

Florida DUI defense attorney AnneMarie Rizzo of the law firm of Finebloom & Haenel won a motion argument recently to exclude evidence, resulting in the State Attorney’s office dropping outright the DUI Refusal charges against her client.

According to court documents, the defendant was driving home in the late night/early morning hours on Siesta Key when he was observed by a Sarasota Sheriff’s deputy making a wide turn from a stop sign. The deputy followed the driver, further observed him swerving over lane lines multiple times, and at this point pulled him over for a traffic infraction.

According to court documents, the deputy made contact with the driver, asked him where he was coming from, and ordered him to hand over his keys, to which the defendant complied. The deputy’s report shows at this time he noticed an odor of alcohol emanating from the driver, slurred speech and bloodshot, watery eyes, and said that the driver was fumbling for his documents, such as driver’s license and registration. The deputy asked the driver to step out of his vehicle to perform field sobriety tests, and the driver exercised his right to not perform the tests. The deputy then placed him under arrest for DUI, searched him, and found bar receipts in his pockets. The defendant was subsequently asked to perform a breath test, which he refused.

The defendant immediately looked to the aggressive DUI attorneys at Finebloom & Haenel for representation in his fight against these DUI charges. Attorneys AnneMarie Rizzo and David Haenel explained to the client their strategies in their first meeting, and began work on the case right away. After Attorney Rizzo took the sworn deposition of the arresting deputy, she filed a motion to suppress all the evidence based upon his illegal seizure of their client. According to court documents, after hearing arguments from the Prosecutor and Attorney Rizzo, the Judge granted the motion to suppress all the evidence. This left the State with no choice but to dismiss all charges against Finebloom & Haenel’s client.

This, however, is an appointment with a difference. Nathan Ballard has been taken on in a paid work experience role. A recent graduate, Nathan is aiming to get some valuable experience in a number of different work environments to bolster his CV.

Having started in the Marketing department at Plumbworld, he has tried his hand at various search engine optimisation activities, with a focus on link building and keywords.

Nathan said, “It’s been really great to try something new and I’ve learned a lot in the time I’ve been here. Skills such as SEO are really valuable and I’m grateful to Plumbworld for taking me on, especially in a paid role as many companies are reluctant to take any recent graduates on and, when they do, they often take advantage of their willingness to work. It’s strange the amount I’ve learned about shower pumps and various other things in the time I’ve been here. I never thought working would be such an educational environment; it has really impressed me!”

After a number of weeks in the Marketing department, Nathan looks set to try his hand in a different position, in the Commercial department. It will certainly provide a different set of challenges but Nathan is prepared. He continued, “When I came into the Marketing department, I was a blank canvas but in the short time I’ve been here I’ve learned a lot, so I’m completely confident about being able to do the same in the Commercial department. I’ve enjoyed working with the guys in Marketing but the new challenge excites me.”

Nathan has obviously made an impression as Scott Morris, Marketing Manager, explains, “It’s been fantastic to have an extra pair of hands around and I couldn’t have asked for a more capable pair than with Nathan. Nathan, a keen golfer, has already settled in well in the new environment. I’ve been impressed by the way he’s thrown himself into the job but more impressed with the way he pays up after a wager on the weekend’s football matches.”

Catholic school administrators gathered in San Antonio February 8 to address new research and important opportunities in the growth of the U.S. Catholic school system. Hosted by the consulting firm O’Meara Ferguson, Whelan and Conway (O’Meara Ferguson), the three-day event, “Sustaining the Mission: Integrating Finance, Development, Planning, and Operations to Strengthen Catholic Education” will assist Catholic school systems in designing financial management plans while maintaining their Catholic mission and identity.

The symposium follows the recent release of “Revitalizing Catholic Schools”, a report by O’Meara Ferguson that provides statistical analysis of more than 400 Catholic schools throughout the Midwest. This data analyzes financial and operational data in Catholic schools, identifying key opportunities for financial success. Findings from the report include:


    Many struggling Catholic schools do not have enough students enrolled at the right tuition rates to pay the bills while addressing mounting maintenance and fixed operating costs. In many situations, especially at older schools, pastors and principals see additional students as added costs for teachers, aides, and supplies; and so are reluctant to increase enrollment. This zero sum game approach leads to underutilized schools with empty seats and lost opportunities for thousands of children.

    Underutilized schools, long thought to be the result of changing demographics and higher tuition rates, are in truth a management opportunity. While demographics and increasing costs may indeed play a role in the demand for Catholic education, enrollment is in fact, far more dependent on management behavior and sound revenue management practices.

Began with Mass celebrated by Archbishop Gustavo Garcia-Siller at the San Fernando Cathedral, the oldest continually functioning church in North America, and continuing at the Marriott San Antonio Rivercenter, the symposium brings together 50 school systems from across the country, joined by their goal to proactively address these challenges, other issues and new opportunities specific to the Catholic school system.

“The goal of our work is to collect and analyze real time school data in order to provide mechanisms that drive positive results,” said Patrick O’Meara, President and Founder of O’Meara Ferguson and co-author of the report.

Each attendee, in addition to hearing expert speakers and peer commentary, will receive a new publication from O’Meara Ferguson, “Sustaining the Mission: A Manual to Revitalize Our Catholic Schools”. Raccoons are among the most adaptable of all animal species, and the National Wildlife Federation’s (NWF) raccoon mascot, Ranger Rick, is showing his adaptability as he enters the digital world. For over 40 years, Ranger Rick magazine has entertained and educated generations of children about the wonders of nature. Now NWF is introducing game apps for kids so they can continue to have fun while learning about wildlife and wildlife habitat in a new delivery platform.

“National Wildlife Federation knows kids are into their electronic devices,” said Mary Dalheim, Editorial Director of Children’s Publications for NWF. “We want to use those devices to educate kids and stimulate curiosity about the natural world so kids can take what they have seen or learned virtually out into the real outdoors.”

The apps are available for playing on iPad, iPhone, iPod and other devices. Each one comes with a free abbreviated version; full versions cost 99 cents to $ 1.99. All proceeds from the sale of these apps goes to support National Wildlife Federation’s conservation work to protect wildlife and wildlife habitat.

Raiders of the Lost Aardvark – for kids 7 and older – The action never stops in this thrilling game of mystery and mummies. Archaeologist Jack Snare has just discovered a rare mummified aardvark. But en route to the Natural Science Museum in Africa, Snare’s precious new find is stolen! Kids join Ranger Rick to track down clues to solve the mystery of the missing aardvark. On the adventure, kids visit different habitats all over Africa including a savanna, a rainforest, highlands, and the site of a mighty waterfall. They meet the awesome wildlife that live in these habitats and learn interesting trivia about plants and animals. (Available for iPad, iPhone, iPod Touch.)

Click the Birdie – for kids 7 and older – In this game, kids become star nature photographers as they travel with Ranger Rick to six wild habitats across the United States including a Cypress Swamp, Arizona desert, and the Hawaiian islands. In each habitat children put their camera skills to the test by snapping pictures of fast-flying birds.

Players score points, learn amazing wildlife facts and are encouraged to go outside to photograph the birds and wildlife in their yard and community. This approach is similar to that taken in Ranger Rick magazine where kids are given activities to help them explore the wildlife where they live. In this way kids go from being passive learners/players to active nature explorers. (Available for iPad.)

Did he eat an umbrella? A tricycle? Or even a giraffe? The game provides instant mobile fun that will captivate kids imaginations, fine-tune their visual recognition skills, and might even make them wonder what real snakes eat.
